主讲人简介：Georgios Pavlakos教授（希腊国籍）为比利时安特卫普大学法学院的法律理论与全球化讲席教授，同时是英国格拉斯哥大学法学院的正教授，同时还兼任捷克科学院国家与法研究所的法与公共事务研究中心主任。他是欧洲法学界著名的法律理论学者，是欧盟范围内法律全球化研究的推动者和组织者，在比利时、荷兰、英国、德国、意大利、希腊和捷克等欧盟国家都有着广泛的学术影响力和学术活动能力。主要研究领域为欧洲国家变革时代的公民身份及其正当性，法律秩序的国际化与欧洲化，法律与道德中的秩序遵守，法与全球化，全球正义理论。出版专著：《关于法的知识》（2007）、《法的本体论与实践理性》（2008）等，发表核心学术论文若干篇。
讲座概要：
In this lecture I will argue that the existence of a global legal order, where the lines between national and international law are increasingly blurred, must be grounded on a scheme of principles of justice (‘Principled Monism’). Rather than neatly structured based on strict separation, automatic incorporation or formal hierarchy of regimes, sources or norms (e.g. international law trumps national law), these principles of justice are in many instances elaborated and further developed, if not constituted, by formally inferior or subinternational law contexts. The global legal order thereby presents itself as a collection of institutionalised norms that develop, expand and promote a scheme of principles of justice, which itself does not depend for its existence on any act of legal authority but merely requires for its activation and implementation some concrete instances of institutional intervention.
